These Terms of Service (“Terms”) govern your access to and use of the PumpSMP Minecraft server, the info.pumpsmp.fun and related websites, the wallet-linking page, and any associated software, content, and services (together, the “Service”), operated by the PumpSMP operators (“PumpSMP,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least the age of majority in your jurisdiction (and at least 18 years old to use any cryptocurrency, payout, or wallet-linking feature). You are responsible for ensuring that your use of the Service — including any use of digital assets — is lawful where you live. You may not use the Service if doing so is prohibited by applicable law or sanctions.

2. The Service & changes

The Service is provided for entertainment. We may add, modify, suspend, limit, or discontinue any part of the Service (including gameplay features, the in-game economy, payouts, ranks, and rewards) at any time, with or without notice. Features described on our websites are aspirational and may roll out in stages or never launch.

3. Accounts & conduct

You are responsible for activity under your Minecraft account and linked wallet. You agree not to: cheat, exploit bugs, use unauthorized mods or automation; disrupt or attack the Service; harass other players; attempt to defraud the economy or payout systems; or violate any applicable law. We may suspend or terminate access, and adjust or void balances obtained through prohibited activity, at our discretion.

4. Virtual items & in-game currency

In-game items, ranks, classes, and the in-game $ balance are virtual, licensed to you for use within the Service, and have no real-world or monetary value. You do not own them and they are non-transferable except through features we expressly provide. We may modify, reset, or remove virtual items and balances. Where a cash-out feature is offered, it is provided at our discretion, subject to published rates, limits, fees, verification, and availability, and may be changed or withdrawn at any time.

5. Cryptocurrency, tokens & financial risk

$PUMPSMP is a memecoin on the Solana network. It is not issued, sold, or guaranteed by us as a security or investment, has no intrinsic value, and carries no expectation of profit.
Digital assets are volatile and high-risk. You may lose some or all value. Nothing in the Service is financial, investment, legal, or tax advice.
Blockchain transactions are irreversible. You are solely responsible for your wallet, keys, transactions, and for any taxes arising from your activity.
We do not control the Solana network, third-party wallets, exchanges, or pump.fun, and are not responsible for their performance, fees, downtime, or losses.

6. Intellectual property

The Service and all of its content — including the “PumpSMP” name, logos, branding, text, graphics, class designs, game mechanics, server configuration, source code, and look and feel (the “PumpSMP IP”) — are owned by us or our licensors and are protected by copyright, trademark, and other laws. Except for rights expressly granted here, all rights are reserved.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own non-commercial play. You may not, without our prior written permission: copy, reproduce, distribute, publicly display, modify, reverse-engineer, create derivative works from, sell, sublicense, or otherwise exploit the PumpSMP IP; use our names or marks; or scrape or harvest the Service. “Minecraft” and other third-party marks remain the property of their owners; nothing here grants you rights in them.

If you submit content (e.g., builds, suggestions, or community posts), you grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, host, display, and adapt it in connection with operating and promoting the Service.

7. AI-generated and AI-assisted content

Portions of the Service, this website, the server software, documentation, and other materials may be created with, generated by, or assisted by artificial-intelligence tools, and we may use AI in operating the Service. You acknowledge and agree that:

AI-generated or AI-assisted content is provided “as is,” may be inaccurate, incomplete, biased, or out of date, and should not be relied upon as professional advice.
To the fullest extent permitted by law, we disclaim all liability for any loss, damage, error, omission, decision, or outcome arising from, or in connection with, AI-generated or AI-assisted content, or any use, misuse, output, or unavailability of AI in connection with the Service.
You are responsible for independently verifying any information before relying on it, and you use any AI-influenced feature at your own risk.

8. Disclaimers — “as is”

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT DATA, BALANCES, OR PAYOUTS WILL BE PRESERVED.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PUMPSMP AND ITS OPERATORS, CONTRIBUTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, DIGITAL ASSETS, CRYPTOCURRENCY, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE, AI-GENERATED OR AI-ASSISTED CONTENT, VIRTUAL ITEMS, OR CRYPTOCURRENCY ACTIVITY — EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US DIRECTLY IN THE [90] DAYS BEFORE THE CLAIM, OR (B) USD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless PumpSMP and its operators, contributors, and affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

11. Third-party services

The Service relies on third parties (e.g., Minecraft/Mojang, the Solana network, wallet providers, pump.fun, and hosting/infrastructure providers). We are not responsible for their acts, omissions, terms, fees, or availability, and your use of them is governed by their own terms.

12. Termination

We may suspend or terminate your access at any time, with or without cause or notice. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnification, and governing law) will survive.

13. Governing law & disputes

These Terms are governed by the laws of [your jurisdiction], without regard to conflict-of-laws rules. Any dispute will be subject to the exclusive jurisdiction of the courts located in [your jurisdiction], unless applicable law requires otherwise.
